Absolute Aluminum, Inc. (“AAI”) will award one (1) grand prize at the end of the prize period. The prize period begins at 08:00:00 AM EST on February 5, 2024 and ends at 04:00:00 PM EST on April 3, 2024. All entries must be received online or by mail by 04:00:00 PM EST on April 3, 2024. AAI’s computer shall be the official time keeping device for the promotion. Three finalists will be determined from a random drawing of all entries received during the prize period. The finalists will be posted on the AAI website and the public will be invited to vote for the grand prize winner. Voting will be held via online balloting from April 8, 2024 at 08:00:00 AM EST through April 18, 2024 at 04:00:00 PM EST. The grand prize drawing will be held on April 22, 2024 at 9:00:00 AM EST. The finalist with the most verifiable votes will be deemed the grand prize winner. The odds of winning the grand prize are determined by the number of entries received prior to the time of the prize drawing and then by the votes cast in favor of the finalist. AAI reserves the right at its sole discretion to suspend, modify or terminate this promotion without notice at any time. The chosen winner will be announced on AAI’s web site, social media, the radio and contacted via telephone. If the chosen grand prize winner cannot be reached they will then be notified by certified mail within 15 days of the drawing. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. All prizes will be awarded.
No purchase is necessary to participate in this promotion, and you do not have to submit to a sales presentation. Void where prohibited by law, rule or regulation. You may enter this promotion for yourself or for a third party by completing the online entry form at https://www.absolutealuminum.com/pool-cage-giveaway/ and uploading the following documentation with your submission: (i) Completed Form DD 214, (ii) photograph of the entering military veteran in front of or next to their existing pool cage (if a pool cage currently exists, otherwise just a good photograph), and (iii) the requested entrance information including name, address, telephone number and email. Alternatively, you may print your name and your complete address, telephone and email on a 3”x5” card, write the words “Absolute Aluminum Grand Giveaway” at the top and submit it with the above-referenced documents to AAI at their address below. No more than one entry per household is allowed. AAI is not responsible for any illegible, misplaced, damaged or late entries due to email errors, computer error, mail delays or otherwise. The address listed on each entry form must be the address where the cage system is to be installed if such entry is selected as a winner.
Sweepstake entrants must (i) be legal residents of Florida and reside in Manatee, Sarasota or Charlotte Counties; (ii) be honorably discharged veterans of the United States military, and (iii) own their own home, which home has a pool that is in a suitable condition (as determined by AAI or its designees) for installation of a pool cage system (including compliance with local building codes and regulations). Employees, officers and directors of AAI, its affiliates, subsidiaries, co-branded partners, consultants, contractors, advertising, public relations, promotion, fulfillment and marketing agencies, their immediate families (and those living in their same households) are not eligible to participate in the promotion.
All entrants understand and agree that submitting information as part of this promotion is consenting to the use – should said entrant be selected as a finalist – by AAI to display the individual’s name, photograph, rank and branch of military service on AAI’s website and related social media channels, including use on radio promotions.
The grand prize winner will receive a AAI professionally installed pool cage system with approximately a $40,000 retail market value. Any costs in excess of $40,000 shall be the sole and exclusive responsibility of the winners. This prize is not transferable by the winner and must be installed at the address listed on the winning entry form. Installation must be provided by AAI personnel or AAI’s designee. Prize subject to availability and may be subject to black-out dates. Installation subject to the terms and conditions of AAI’s standard installation guidelines. All expenses not specifically provided for are the sole responsibility of the winners.
Winner’s residence must be in suitable condition for pool cage installation (e.g., no water, ground or structural damage, etc.). Any waterproofing, remediation or other repairs necessary for proper installation (as deemed by AAI or its designees in their sole discretion) must be performed at owner’s expense prior to installation of the pool cage. Installation labor does not include painting, lighting or security systems. No transfers, substitution in prizes or cash will be allowed except by AAI, who may substitute a prize of equal or greater value in its sole or absolute discretion. Cash value of the prize is deemed to be $10,000. Upon installation of prize, AAI will be deemed to have awarded the prize to the winner with the winner assuming full ownership and responsibility for the prize. Winner must arrange for prize installation no later than one month following the award of the prize. and installation must occur and be completed within six months of confirmed notification.
The grand prize winner understands and agrees to allow the use of their pool cage for marketing photos, which AAI may use in various types of advertising in its marketing promotions, including, for example, television, newspapers, brochures, the internet and magazines. Photographs or recordings AAI makes belong to AAI, and AAI will own those forever and can use them, or not use them, and modify or edit them, however they wish in their future advertising and marketing.
The winner must comply with all instructions in the prize notification correspondence, including the completion of an affidavit of eligibility and liability/publicity release, and return them within fourteen days of the date on the prize notification correspondence as well as have met all of the eligibility requirements set forth within these Rules; otherwise prize will be forfeited and an alternate winner will be selected. Acceptance or use of a prize constitutes permission for AAI and its affiliates to use recipients name and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
Liability for any applicable taxes, including all federal, state, and local taxes and/or other fees that may apply to prizes are the sole responsibility of the winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. All expenses not specifically provided for by AAI in these Rules are the sole responsibility of the winner.
Entries that are lost, late, illegible or incomplete for any reason will not be eligible. AAI reserves the right to modify or terminate this Sweepstakes at any time or disqualify any entry in good faith. In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the winning home is titled.
By participating in the promotion, participants agree to release, discharge and hold harmless AAI, its affiliates, co-branded partners, subsidiaries, retailers, agencies and their respective officers, directors, employees and agents, from any damages which may arise out of participation in the promotion in any way or out of the acceptance, use, misuse or possession of a prize.
